Leading real estate businessman Niranjan Hiranandani has filed a suit in the Bombay High Court seeking to restrain his married daughter Priya Hiranandani Vandrevala from using the name 'Hiranandani' in her business.

The suit, filed by Niranjan, his brother Surendra and their company Hiranandani Constructions Private Ltd (HCPL), has sought Rs 50 crore damages for alleged infringement of copyright and trademark by Hiranandani Living Pvt Ltd promoted by defendant Priya. The suit would come up for hearing on March 10 before Justice S J Kathawala.

Hiranandani Construction Pvt Ltd is a well known brand in the premium segment of the real estate industry, not only in Mumbai but also in many cities across the country such as Pune, Bangalore and Chennai. The company also has business ventures in Dubai.

Niranjan and others contended that "the defendants are passing off their business/services/activities as those of the plaintiffs" and that they had suffered irreparable harm and injury due to the alleged infringement.

"The manner in which the defendants have set out using the mark 'Hiranandani' is clear evidence of dishonest and fraudulent intentions of the defendants to deceive and confuse the public, consumers and traders," the suit contended.

"The family is in talks (with the other group) on the methodology to use the Hiranandani brand in the future. (We are) likely to work it out shortly," a spokesman of Hiranandani Group said.
