The petitioners, employees of HMT and ITI, had moved the High Court challenging the roll back. The companies had increased the retirement age to 60 years in 1998 from 58 years. However, it was rolled back to 58 in 2003.
The petitioners sought a direction against the roll back. The Government, in its submission, said that it is a policy decision. The division bench headed by Justice V Gopalgouda said that the matter should be heard by a different bench.
