16-yr-old charges husband with rape

Cops remind she is minor, charge valid even if no force used

A 25-year-old man has been arrested for allegedly raping a minor girl whom he married at a temple in south-east Delhi’s Govindpuri. The accused as well as the alleged victim hail from Nepal.

The 16-year-old victim had been staying with her grandparents and aunt in Govindpuri after she shifted from Nepal to Delhi after her parents’ death a few years ago.

The accused is her neighbour and works for a private company. They had met about a year ago and fell in love. Her family was unaware of her relation with the accused, they told police.

The man had been insisting that they get married. The girl finally relented and they went to the Kalkaji Mandir on last Wednesday and got married without the knowledge of her family.

When the family did not see her return home on Saturday, they first launched a search for her and contacted her friends who were found unaware of her whereabouts. They then filed a missing complaint with Govindpuri police station the same day.

“The girl returned home the next day and told her family that she was married. They brought her to the police station to lodge a complaint that she was raped by the man,” said a police officer associated with the case.

According to the officer, the girl changed her statements a few times before confirming that she was unwilling to have sex with the man after their marriage and was allegedly forced by him. They had stayed at a hotel after their marriage where the alleged rape took place.

Police said she was sent for a medical examination which confirmed rape. The accused was arrested the same day at his residence. He has been charged with rape and under the Protection of Children from Sexual Offences (POCSO) Act.

Police said even if it is proved that he did not force himself on the girl, the rape charges would still apply as the girl is a minor.
