Approach tahsildar, HC tells lakebed evictees

The High Court of Karnataka on Tuesday disposed of a petition filed by some residents of Padmanabhanagar challenging their eviction from the encroached Chikka Kallasandra lakebed on 22nd Main Road in Padmanabhanagar.

Justice B V Nagarathna directed the petitioners to approach the jurisdictional tahsildar who had issued notices to the 90-odd residents as per the Karnataka Land Revenue Act to appear for hearing on November 28. During the hearing, the petitioners’ advocate submitted that no show-cause notice was issued to the residents before the orders were passed for eviction.

The advocate also submitted that the houses and the apartment complexes that have been constructed were approved by the BBMP. The bench then observed that as the tahsildar had issued notices, the residents can appear for the hearing and record their statements. The bench granted a further stay on the demolition of the houses and apartment complexes till the date of hearing at the tahsildar's office.

The bench directed the petitioners to appear before the tahsildar on November 28 with relevant documents and replies to the notices issued to them on November 13. 

The court also gave directions to the tahsildar to consider the replies of the petitioner and to give them the opportunity to be heard.
