One acre of government land encroached by Police Society

Tahsildar reports to MUDA seeking revocation of layout plan

Even as the government is going all out to reclaim government lands encroached by the private parties, a classic case of law makers turning into law breakers has emerged.

This follows a recent report from Tahsildar Naveen Joseph to Mysore Urban Development Authority (MUDA), a copy of which is available with Deccan Herald. In his report, the Tahsildar has sought revocation of layout plan and action against the perpetrators, for facilitating Karnataka Police House Building Cooperative Society in developing 20 sites, after encroaching one acre of land between survey numbers 76, 77, 78, 81, 82, 83, 86, 87, 88 and 89, belonging to the government at Lalithadripura village, Varuna hobli in the taluk.

The disputed site is a government passage (oni) located in between the given survey numbers. 

Following a complaint from one B N Nagendra on September 3 alleging that the passage had been encroached upon by the said Society, the Tahsildar had directed the taluk land surveyor to vet into the same and submit a report.

In his report, the taluk surveyor too had confirmed that the said passage belonged to the government as mentioned in the village map and survey records. The passage leads to the agricultural fields of the village. It comes under ‘B’ kharab land according to Karnataka Land Revenue Section 1967(1) and cannot be sold.

Interestingly, MUDA gave a go ahead to the same, with the then commissioner and the officials at the planning section of the Authority approving the layout plan including the encroached land, on December 29, 2012. Following which, the Society distributed sites to the applicants. A house has also been constructed on the site measuring 40ftx60ft at the land in question.
