ULBs likely to tax mobile towers, advt structures

Telecommunication towers and advertisement structures in all urban local bodies (ULBs), including the Bruhat Bangalore Mahanagara Palike (BBMP), will soon be taxed. The State government on Friday tabled an amendment bill in the Legislative Assembly, seeking to levy this tax.

The Karnataka Municipalities and Certain Other Law (Amendment) Bill, 2014, empowers the ULBs to levy tax. Both the Karnataka Municipal Corporations Act, 1976, and the Karnataka Municipalities Act, 1964, will be amended for this purpose. However, the government has not elaborated on the definition of advertisement structure in the bill.
Lacked power

The BBMP had taken steps to impose this tax in 2010. It had decided to collect Rs 12,000 per month from each tower. The State government had also approved it. But a single bench of the Karnataka High Court had said that the ULBs didn’t have the powers to impose this tax.

However, a divisional bench of the High Court set aside the single-bench order and authorised the BBMP and other ULBs to collect the tax after bringing in necessary amendments to the Karnataka Municipal Corporations Act and the Karnataka Municipalities Act.
