HC tells BBMP to detail Rs 13,000 crore spend

Hearing a PIL filed by former mayor P R Ramesh and others, the division bench comprising Justice V Gopala Gowda and Justice A S Bopanna has directed the BBMP to place before it project details like estimates, pre-qualification tender notification including the authorities who invited and accepted tenders, as well as the government approval.

The petitioners had stated that the tender notification issued on September 23, 2009 and January 1, 2010 are contrary to the Karnataka Municipal Council Act (KMC Act) and the Transparency Act.

According to the petitioners, if the pre-qualification value is above Rs 10 crore, several procedures like publishing the tender in Indian Trade Journals needs to be followed, which has been flouted.

As the project runs into several thousand crores of rupees, the BBMP should place the Detailed Project Report (DPR) before the Cabinet for approval, the petitioners contended.  
Citing that many of the projects looked imaginary, the petitioners said that a proposed six-lane flyover connecting High Grounds and Hebbal is one among them, as there is no place for constructing such a flyover. “The rate quoted by the bidder for higher side was accepted and no work code has been issued,” said petitioners.

Pointing out that no procedure was followed in finalising the tender of the magnitude of Rs 13,000 crore, the petitioners said that the BBMP officials have not discussed the projects in detail.

Though the total value of the project was quoted at Rs 12 7773.99 crore, the annual income of the BBMP is just Rs 600 crore, petitioners argued.

The bench has adjourned the matter.
