BJP MLC Tara Anuradha has wondered if the Home Department was going soft on a male nurse who has been accused of molesting a 54-year-old female patient at Fortis Hospital here on October 31.

Raising the increasing incidents of sexual assaults against women and children in the State, in the Legislative Council on Wednesday, Tara wondered if the police were going soft in the case as it involved a “corporate hospital”. The police didn’t even book the male nurse for rape under section 376 of the IPC. The suspect was released on bail just two days after his arrest, she noted. She accused the police of handling the case “irresponsibly” and demanded appropriate action.

Home Minister G Parameshwara replied that the victim’s husband himself had lodged the complaint while she had made a statement before the magistrate under section 164 (recording of confessions and statements) of the CrPC. Nowhere in her statements or her husband’s complaint was there any accusation of rape under section 376. Hence this section has not been invoked, he added.

The minister said the investigation into the alleged sexual assault was being carried out by the ACP of Seshadripuram subdivision. Action will be taken against the hospital management if it was found guilty. He said legal opinion was also being taken and investigation was being conducted in a transparent manner. The charge sheet will be submitted to the court shortly, he added.
