HC directs industries to pay for infra in KIADB layout

The High Court has directed the industries which were allotted land in Devanahalli’s Karnataka Industrial Areas Development Board (KIADB) Industrial Layout to pay half of the remaining amount of 80 per cent within 15 days so that the board can develop infrastructure there.

Justice Anand Byrareddy on Friday passed the order on a batch of petitions by Bogineni Hospitality India Pvt Ltd and other allottees. The judge also directed the KIADB to simultaneously execute lease deeds and hand over possession of the respective plots.

The petitioners had moved the court questioning the retrospective effect of a government order dated August 7, 2014, as per which industrial plots will be allotted on lease for 99 years.

In the earlier scheme, industrial land was allotted on lease-cum-sale basis for 10 years, after which the allottee could sell the property.

Many industries were allotted land in the KIADB layout in 2010 before the government order came into retrospective effect.

The allottees also mentioned that the KIADB had failed to develop infrastructure in the layout, though they had paid 20 per cent of the allotment price.

The counsel for the KIADB stated that the board does not have the funds to develop the layout and the only source would be the allottees.

The bench then directed the allottees to pay 50 per cent of the remaining amount for developing the layout, and disposed of their petition.

Deadline extended
The High Court on Friday granted more time to the State government for submitting the report on allotment of ‘G’ category sites by the Bangalore Development Authority.

 After rejecting the Justice Padmaraj Committee report on the irregularities in the
allotment of 640 ‘G’category sites by the BDA between 2006 and 2008, the State
government constituted another three-member committee to probe the matter, in accordance with a High Court order.

High Court judge (retired) Justice A M Farook heads the panel.

Details sought
The High Court on Friday sought to know which law had been violated in BBMP allotting two acres of land near Jakkarayanakere to JD(S) for construction of its office.

During the hearing of a PIL questioning the allotment of land, the petitioner contended that the land, which was meant for constructing a hospital had been allotted to JD(S).

However, division bench comprising acting Chief Justice S K Mukherjee and Justice B V Nagarathna asked the petitioner to submit details about which law had been violated in allotting the said land to the party office in the next hearing. The matter was adjourned to November 23.
