Begur-Hulimavu road widened as per norms for DLF project, BBMP tells High Court

The Begur-Hulimavu road in southeastern Bengaluru has been widened adequately to pave way for construction of a high-rise apartment complex by DLF Southern Homes Pvt Ltd and M/s Suadela Constructions Pvt Ltd, the Bruhat Bengaluru Mahangara Palike (BBMP) told the High Court on Friday, prompting it to dispose of a petition against the project.

A man named Anil Agarwal had moved the High Court, contending that the road was too narrow for construction of a 30-floor apartment which was approved by the Bangalore Development Authority (BDA) commissioner.

Earlier, the road width was just 9.6 metres and the FAR (floor area ratio) allowed construction of only four floors. But anticipating sanction of 30 floors, the developers widened the road to 24 metres. The BDA commissioner then sanctioned the project.

Only 18 floors
However, the BDA’s Comprehensive Development Plan (CDP) approved widening of the road to 18 metres, meaning that only 18 floors could be built as per the FAR.

The petitioner argued that widening the road to 24 metres was not possible without encroaching on a storm water drain, government land and some private property.
The petitioner made senior IAS officers Bharat Lal Meena, K M Shivakumar, Pradeep Singh Kharola, the BDA, the BBMP and the State government respondents.

A division bench comprising acting Chief Justice S K Mukherjee and Justice Ravi Malimath disposed of the petition after the BBMP’s counsel submitted that the road was widened as per the norms and the FAR was adhered to.

The case first emerged in 2012 when the Bangalore Metropolitan Task Force (BMTF) registered an FIR against BDA officials and grilled some of the former commissioners for approving the project.
