The high court on Thursday ordered notices to Ministry of Law and Justice, Ministry of Water Resources, Government of India and the state government in a petition seeking directions to strike down Section 6(2) of the Inter-State River Water Disputes Act, 1956.
Section 6(2) says, “the decision of the Tribunal... shall have the same force as an order or decree of the Supreme Court.”
The petitioner Prof B Shivalingiah has approached the court seeking a stay and quashing of the Section 6(2) of the Act which was inserted through an amendment in August 2002. It has made the award of the Tribunal immune from challenge. Justice A S Bopanna ordered notices and adjourned the hearing.
