SC dismisses plea by ex-registrar of BU

The Supreme Court on Monday dismissed a plea by former registrar of Bangalore University B C Mylarappa to modify the July 12 order wherein his statement was recorded that he would not seek any appointment in the varsity.

A bench of Chief Justice T S Thakur and Justice D Y Chandrachud had then disposed of a civil appeal filed by Mylarappa after recording his counsel senior advocate Gopal Subramaniam's statement that he has resumed his duty as professor in the sociology department of the university and was not interested in reverting to the post of registrar.

It was also taken on record that “he did not propose to seek any appointment for any other post in the university”.

On Monday, senior advocate Kiran Suri, appearing for Mylarappa, contended, “The inadvertent typographical error makes him ineligible for any other post in the Bangalore University, which is contrary to the statement made on behalf of the appellant.”

The court, however, saw no reason to clarify or modify its previous order. It observed that the HC had quashed Mylarappa's appointment, noting that his ascension to the post was due to political reasons.

“Mylarappa is politically well-connected and therefore any modification of the order would enable him to apply for any higher post in Bangalore University,” the court further said, declining his plea.

Varsity alumni P M Parameswara Murthy and others, represented by advocates Balaji Srinivasan and B M Arun, had challenged Mylarappa's appointment to the post of registrar, Bangalore University.

A division bench of the Karnataka High Court had on November 21, 2012 quashed Mylarappa’s appointment with immediate effect.

The high court had then also pulled up the state government for failing to look into a report submitted by an expert panel indicting Mylarappa for alleged plagiarism in his own thesis.

“In the interest of the students and maintaining standards, such persons should not be allowed to continue in the said post,” the bench had maintained.
