The Federation claimed that the RTE Act was contrary to the rights guaranteed to the member institution as per Articles 29 and 30 of the Constitution.
The petitioner submitted that as per Section 141 of the Act, the RTE Act or the rules made were not applicable to any minority educational institutions to the extent they are inconsistent with the rights guaranteed under Article 30 of the Constitution.
