Court quashes case against Sania, Khushboo

Judicial Magistrate Suman Srivastava said both Sania and Khushboo had expressed their views on pre-martial sex keeping in mind the AIDS factor.

"Therefore, prima facie there is no merit in taking cognizance of the case," Srivastava said and dismissed the case on July 7.

"Every citizen, according to the Constitution, has the right to freedom of expression," Srivastava observed.

One Manohar Bhamare, based on newspaper reports, filed a case against the duo on November 18, 2005 claiming their "obscene views had hurt the feelings of his three unmarried daughters and scores of girls across the country".

In an interview in 2005, Khushboo had said that it was not wrong for women to have pre-martial sex as long as they took precautions. Following this, criminal cases were filed against her in several courts.

Sania then made similar remarks but after protests she strongly denied giving such comments.

This year, the Supreme Court had dismissed all 22 criminal cases against Khushboo.
