Culpable homicide rap against rash driver

The 13th Fast Track Court has ordered police to book Somaiah under the Section for committing culpable homicide not amounting to murder.

Penal provisions under the Section carry imprisonment for life or imprisonment for a term which may extend to 10 years, and also fine.

Reacting to the court order, senior counsel M T Nanaiah said he will file a petition before the High Court against the order. “We have ninety days of time to move to the HC. Earlier, we had requested the court to book him (Somaiah) under Section 304A of the IPC,” he said.

Section 304A of IPC deals with causing death and injury by negligent manner under which the maximum punishment would be imprisonment for two years or with fine, or with both.

Somaiah, who was driving a Honda Accord mowed down four people in Indira Nagar area early on January 24, 2009. Investigation revealed that the car moved at a high speed, hit a cyclist, and later hit three early morning joggers.

He was let on bail by the Second Fast Track Sessions Court on February 2009, on a personal bond of Rs 50,000 and a surety.
