Daily wager gets 7 years’ RI for raping minor

A 44-year-old man convicted of raping a minor has been sentenced to seven years of rigorous imprisonment and slapped a fine of Rs 20,000.

Hameed, a daily wager and resident of Katipalla, had befriended the victim, who was living with her mother near Surathkal. On February 22, 2014, Hameed raped the minor when she was alone in the house and threatened her of dire consequences if she revealed the incident to anybody.

When the minor became pregnant, Hameed promised to marry her. Instead, he got the pregnancy aborted by forcing the victim to consume pills and then refused to marry her.

The victim filed a complaint with the Surathkal police. Inspector M A Nataraj arrested Hameed and filed a charge-sheet in court.

Second Additional District and Sessions Court Judge Pallavi B R upheld the arguments of Special Public Prosecutor Venkatramana Swamy and convicted the accused to seven years’ rigorous imprisonment and a fine of Rs 10,000 under Section 376 IPC (Rape) and Section 4 of Protection of Children Against Sexual Offences (Pocso) Act. Hameed will have to undergo an additional six months of rigorous imprisonment if he fails to pay the fine.

The accused will also undergo seven years of rigorous imprisonment and pay a fine of Rs 10,000 under section 313 IPC (Causing miscarriage without woman’s consent).

Both sentences will run concurrently and a fine of Rs 15,000 should be given to the victim. The victim is also eligible for a compensation from the District Legal Services Authority, the judge noted.
