Explained | FCRA amendments: What’s changing and why Congress, LDF are worried?

The Union government’s latest move to amend the Foreign Contribution (Regulation) Act (FCRA) has once again brought the spotlight back on a law that quietly shapes how civil society functions in India.

While the government argues the changes are about transparency and national security, Opposition parties like the Congress and the Left Democratic Front (LDF) in Kerala say the amendments go much further and that they could fundamentally alter the way non-profits operate.

What is FCRA?

At its core, the FCRA is meant to regulate foreign funding. Any organisation in India — typically NGOs working in areas like education, health, environment, or human rights — must be registered under the law to receive money from abroad. The idea, at least on paper, is straightforward: ensure that foreign funds do not influence India’s political processes or harm its sovereignty.

But over the years, the law has steadily tightened. NGOs now face stricter compliance requirements, limits on how much they can spend on administrative costs, and a ban on transferring funds to smaller partner organisations. Many grassroots groups say this has already made their work harder, particularly those that rely on larger NGOs for funding.

The latest amendment bill, introduced in Parliament on March 25, takes this a step further. One provision has drawn particular attention — the creation of a government-appointed authority that can take control of assets created using foreign funds if an organisation’s FCRA licence is cancelled or lapses. These assets could then be managed, transferred, or even sold, with proceeds going to the state.

This is where the political pushback has sharpened.

Why it has sparked a row?

Leaders from the Congress have argued that the provision effectively allows the government to “appropriate” assets built by independent organisations. They say this creates a chilling effect: NGOs may become more cautious, or even self-censor, fearing that regulatory action could eventually lead to loss of their infrastructure and resources.

The LDF government in Kerala has framed the amendments as part of a broader pattern of tightening control over civil society. According to LDF leaders, the FCRA is no longer just about regulating foreign funds but about determining who gets to operate freely in the public sphere.

The critics argue that enforcement has sometimes been selective, targeting groups working on sensitive issues such as human rights or minority welfare.

The new provisions, they say, deepen that imbalance. If the state can not only cancel licences but also take over assets, the stakes become much higher for organisations that rely on foreign funding to function.

The government, for its part, maintains that these fears are overstated. It argues that the amendments close legal gaps, particularly around what happens to assets created using foreign contributions after an organisation loses its licence. Officials say the goal is to prevent misuse and ensure that such assets continue to serve public interest rather than being diverted.
