Can the deceased testify? Dead man named witness in his own death in Gujarat: Report

In Gujarat, even the dead aren't spared from the rule of law. In a peculiar turn of events, a man was called on to testify in case that resulted in his own death. This bizarre order raised many eyebrows, ultimately leading to the question- Can a man who is no more testify in a case involving his own death?

According to a report by Times of India, a 26-year-old man named Poonam Senva was fatally knocked off his bike when a truck rammed into him. He was driving on the Viramgam-Sanand highway on the night of December 8.

He was brought to a hospital in Sanand where he succumbed to his injuries.

The deceased hailed from Sanand's Khoraj village.

Poonam's elder brother Baldev registered an FIR before PSI NR Tarar and said, “The truck driver drove his vehicle with speed and negligence and rammed into the motorcycle of Poonam Senva. In the accident, 'sahed' (witness) Poonam Senva suffered critical injuries and succumbed to his injuries at a private hospital in Sanand."

The police filed a case against the truck driver, charging him under with causing death by negligent and rash driving under the Bharatiya Nyaya Sanhita and the Motor Vehicles Act.

However, this isn't the first time the deceased has been named in cases which resulted in their own deaths.

The report says that more often than not, especially during accidental deaths, the deceased themselves are named as the accused as it is difficult to probe further to find the actual reason or cause behind the accident.

There have also been reports of a cow and a motorcycle being named for two deaths.
