<p>The stand was taken by the accused who contended that a false case was registered against them and an attempt had been made by the police to implicate him in the case.<br /><br />"It is highly objectionable that Soumya's father was allowed to take away her belongings from the car and when the police realized its mistake, the next morning it took the articles back from him," Amit Kumar, counsel for the accused, said.<br /><br />He made the submission during the cross-examination of Soumya's father M K Vishwanathan who said the city police had allowed him to take away his daughter's bag and mobile phone from her car after he reached the spot. <br /><br />Vishwanathan recorded his statement before Additional Sessions Judge R Kiran Nath and said he was informed by a police constable over phone about Soumya's accident and when he reached the spot, he was told that his daughter has been taken to AIIMS Trauma centre.<br /><br />Accused Ravi Kapoor, along with Ajay Sethi, Baljeet Singh Malik, Amit Shukla and Ajay Kumar were arrested for allegedly tailing the journalist on September 30, 2008, night when she was returning home by her car from office at Jhandewalan at around 3:30 am and shot her dead near Vasant Kunj.<br /><br />"It is a false case and my clients (five accused) were falsely implicated in it. They were arrested in Jigisha Ghosh's murder case and simply to solve the Soumya's murder case, the police arrested them in this also," Kumar said. The court has fixed August 20 as the next date of hearing.<br /><br />All the five accused were booked under stringent Maharashtra Control of Organised Crime Act (MCOCA). Initially, four accused, except Ajay Sethi, were booked under various provisions of the IPC relating to charges of murder, robbery, cheating and possession of stolen properties.<br /><br />Sethi has been charged under a milder penal provision dealing with keeping stolen property. Subsequently, they were booked under MCOCA after police claimed they were involved in several such cases including the murder of IT executive Jigisha Ghosh.</p>
