'We are old fashioned': Supreme Court asks boys and girls to be careful about pre-marital physical relationships

New Delhi: The Supreme Court on Monday advised the boy and the girl to be careful and exercise circumspection before indulging in pre-marital sex.

A bench of Justices B V Nagarathna and Ujjal Bhuyan said, "Before marriage a boy and a girl are strangers. Whatever may be the thick and thin of their relationship. We fail to understand how they can be indulging in physical relationship before marriage. Maybe we are old-fashioned. You must be very careful, nobody should believe anybody before marriage”.

The court was dealing with a bail plea by a man arrested for rape on the false promise of marriage.

The court questioned the 30-year-old complainant who alleged that the accused met her on a matrimonial site, and solemnised a second marriage with another woman after making a promise to marry her, despite being already married, and indulging in a physical relationship with her in Delhi and Dubai.

The bench asked her as to why she travelled to all the way to Dubai, saying if the woman was particular about marriage, she should not have travelled before it.

"It is consensual. She should not have gone before marriage if she was so strict about it. We will send them to mediation. These are not cases which are to be tried and convicted when there is a consensual relationship,'' the bench said, fixing the matter for ascertaining the possibility of settlement.

The woman alleged, in Dubai, the man established physical relations with her on the false pretext of marriage and recorded intimate videos without her consent, threatening to circulate them if she resisted. The woman said that later she learnt that he had got married in January 2024 in Punjab.
