A Bench of justices P Sathasivam and B S Chauhan, however, decided to hear on Thursday the review petition filed by another convict  Ramabhadran Nair. The Court had on February 10 convicted the former minister and two others while reversing the acquittal order passed by the Kerala HC on the appeal filed by Chief Minister V S Achuthanandan.  Balakrishnan challenged his conviction through a review petition saying that Achuthanandan had no locus standi in filing the appeal against the HC order.

In its earlier verdict, the apex court had upheld the prosecution plea that the former minister has entered into a criminal conspiracy causing a loss of over Rs 2 crore to the Kerala State Electricity Board by awarding contracts for construction of a power tunnel and surge shaft of the Idamalayar hydro electricity power project to contractor Paulose  at extra ordinarily high rates.
