Gujarat govt to move SC over Pandya case

The move came following petition by Haren Pandya’s wife Jagruti seeking a reinvestigation into the case. The Gujarat High Court, in its decision on August 29, had dropped murder charges  against 12 people, convicted for the assassination of Pandya.  Interestingly, even the CBI has told the court that it will appeal against the verdict. Though the state government was not directly involved in investigations it had been made respondents in the case by Jagruti. Significantly, Jagruti after the acquittal verdict had requested the chief minister to take a lead in getting her the justice, but the government had that time maintained that it was for the CBI to appeal against the acqutal.

“I moved the High Court for reinvestigations in the case. The High Court in its last order had criticised the CBI for loopholes in investigations and let off all the accused. I want the real accused to be arrested,”Jagruti had said.

During the previous hearing, the division bench of Justice D H Waghela and Justice J C Upadhyaya had slammed the CBI and called its investigation botched up. Though CBI had claimed that Pandya was killed to avenge the 2002 post-Godhra communal riots, the family of the slain BJP leader, particularly his late father Vitthal Pandya, had alleged that he was targeted for political reasons.

Pandya, was shot dead on March 26, 2003, near Law Garden area of the city when he had gone for a morning walk. He had sustained seven bullet injuries. Pandya was once considered very close to Chief Minister Narendra Modi but had drifted away from him and even resigned from the government.
