HC levies cost of Rs 2,000 for wrong impleading

P V Murali Kumar had impleaded station house officer and sub-inspector of Malur and superintendent of police, Kolar in a contempt petition for not allowing him to meet his wife Asha in accordance with the High Court order.

The Division Bench comprising Justices N Ananda and Justice Suri Appa Rao while hearing a habeas corpus petition by Byrappa, father-in-law of the petitioner on August 17, 2011 had directed the jurisdictional police to send Murali’s pregnant wife with her parents. Murali was given visiting rights.

However, he filed a contempt petition claiming that despite the court order, he was not allowed to meet his wife, and his father-in-law threatened him with dire consequences if he tried to meet his wife.

Wife threatened

Submitting that his wife was also being threatened by his in-laws and was being forced to sever relationship with him and abort the child, he said that police were not helping him to visit his wife.

He had claimed that the house was locked when he visited and neighbours informed him that they were missing for the past ten days. He sought directions against the police and his in-laws for violating the court orders.

Justice N Kumar on finding the two officers who had appeared before the Court on the first hearing, sought to know the reason for impleading the police officers.

He directed that their names be deleted from the petition and levied a cost of Rs 2,000 on the petitioner.
