Judge recuses from hearing Ashwin's bail plea

The Karnataka High Court judge, Justice L Narayanaswamy on Wednesday recused himself from hearing the bail application of former Lokayukta Justice Y Bhaskar Rao’s son Ashwin Rao and his aides who are accused of corruption and extortion.

The judge said that he had already given his opinion while hearing the bail petition previously and that he had nothing more to say and passed an order to place the petitions before another judge.

The bench had previously granted bail to Syed Riyazathulla, Ashok Kumar, H S Rajashekhar, B M Srinivas Gowda, H S Rajendra and N Narasimha Murthy.   However, the Special Investigation Team (SIT) had approached the Supreme Court which granted stay on the bail and passed an order to approach the High Court for bail.

As per the apex court’s directions, the same bench has to hear the matter after the petitions are directed to be heard before the High Court. However, the bench has recused to hear the matter again. Ashwin and Bhaskar had not applied for bail previously and have applied only in April this year.
