CWG scam: properties of three accused to be attached

The court directed the attachment of properties of promoters of two construction firms -- Purshottam Dev Arya, Anil Madan and A K Reddy whose anticipatory bail appplications are pending before the Delhi High Court.

They were declared proclaimed offender by the court on May 23.

"In my view, all legal requirements under section 82 CrPC (declaring proclaimed offenders) have been complied with. There is no provision in the Code of Criminal Procedure for allowing them not to appear before the court. Let proceedings under section 83 CrPC (for attachment of properties) begin ," Special CBI Judge Talwant Singh said.

The court directed CBI to submit a detailed list of movable and immovable properties of Arya, Madan and Reddy by tomorrow.

Dev and Arya are the promoters of Faridabad-based Gem International, a sub-contractor of Swiss Timing. The duo has further sub-let the TSR contract to A K Reddy's AKR Construction based in Hyderabad.

Their undertaking to surrender before the court in case of any adverse verdict from the High Court and exemption from personal appearance were also rejected.

"The accused had 30 days' clear notice from dates of publication of order declaring them proclaimed offenders to appear before the court on July 14 and they have intentionally not appeared," the court said.

The statement of the CBI inspector and the Investigating officer were also recorded in this context.
