The High Court, on Monday, issued notices to all the advocates associations in the State following a petition contending that lawyers should not hold strike.
Petitioner Vishwanath Swamy has contended that Section 35 of Advocates’ Act states that state bar councils should take suo motu cognizance of any unruly behaviour of advocates and punish them for their misconduct.
Also, Bar Council of India can take action under Section 36 through suo motu cognizance and act against erring lawyers, he said. Bangalore Advocates Association President K N Subba Reddy and General Secretary of Advocates Association of Bangalore (AAB) A P Ranganath were called to the court and were given notices.
Swamy has sought for implementation of the judgement of Supreme Court in Rajesh Uppal case where it was said strike is not permitted. Before holding a strike a procedure should be followed. The procedure involves grievance redressal committee, he said.
