"The accused should be present," judge B M Mallikarjunaiah said in his order fixing July 27 for recording of their statements under section 313 of CrPC (power to examine the accused).

Later, senior counsel for Jayalalithaa, B Kumar filed a petition stating that he needed to make certain submissions on the legal aspects of Section 313 post amendment in 2008.
Mallikarjunaiah adjourned the petition for hearing to July 25 and posted the case to July 27 for recording of the statements of the accused –– Jayalalithaa and her close friend Sasikala Natarajan.

Sudhakaran and Ilavarasi, relatives of Sasikala, are the other two accused.
The case was transferred from a Chennai court to Bangalore by the Supreme Court in November 2003 during the previous regime of Jayalalithaa.
