HC sets aside order on shifting of transformers

 A division bench of the High Court of Karnataka on Wednesday set aside the order of the single judge directing the Bruhat Bangalore Mahanagara Palike to clear footpaths of transformers in the City.

Hearing an appeal by Bescom which contended that the order of single judge was beyond jurisdiction, the division bench comprising Chief Justice D H Waghela and Justice Ashok B Hinchigeri set aside the order dated July 24, 2014. It also observed that the order was beyond the jurisdiction. “In view of Supreme Court’s directions, judiciary cannot go beyond the jurisdiction and the scope of the petition,” the bench said and disposed of the matter.

 The order was passed following a petition by Ashwini Manoj Patil who had moved the High Court seeking compensation from the Bescom after her husband Manoj Patil was electrocuted on May 18, 2013 on Church Street in the City. Manoj had come in contact with the fence of the transformer.
