Premnath had approached the Court challenging the order of Justice Anand Byra Reddy who had quashed his appointment as MD after the suspension of his predecessor R Ramalinge Gowda.
The Division Bench comprising acting Chief Justice Vikramjit Sen and Justice A S Bopanna on September 28 had ordered fresh hearing in the matter.
Gowda approached the Court challenging the creation of an additional post of MD and appointment of Premnath to it on July 2, 2011, after he was suspended.
