Former BDA commissioner T Sham Bhatt gave the agency’s Assistant Executive Engineer, Rajagopal, oral instructions to write to the Bruhat Bengaluru Mahanagara Palike (BBMP) for withdrawing the sanction given for a multi-storey building of Sri Ramachandrapura Mutt in Bengaluru, the high court was informed on Friday.

The mutt has challenged the order of the BBMP’s Assistant Director (Town Planning), South, Syed Mubashir Ahmed, who had cancelled the building plan sanctioned to it for construction of a multi-storey community hall (dharmashala) in Girinagar.

Hearing Rajagopal’s oral submissions, Justice Vineet Kothari directed him to file an affidavit on what he has to say about the cancellation of the sanctioned plan.

The judge had previously directed the BBMP’s Chief Engineer (South), H T Bette Gowda, Joint Commissioner (South) A J Hemachandra, besides Ahmed and Rajagopal to deposit Rs 50,000 each with the high court registrar general as security deposit.

While Rajagopal deposited the amount, the BBMP engineers filed an interlocutory application seeking exemption from making the deposit.

Refusing to grant the exemption, Justice Kothari directed them to first deposit the money and submit the interlocutory application by the end of the day.

According to the mutt, the BBMP had sanctioned the building plan on property number 2A, JP Road, Vishwa Bharati House Building Co-operative Society, Banashankari 3rd Stage.

Later, a PIL was filed that argued that the property is a civic amenity site which was encroached upon by the mutt. On January 6, 2016, the BBMP cancelled the sanctioned plan.

The mutt argued that the BBMP cancelled the plan without giving it an opportunity of being heard.
The judge adjourned the hearing until July 21.
