DoE's door knocked to revoke student's expulsion

Social Jurist, a civil rights group has written a complaint to the Directorate of Education on Friday against a school in Vasant Kunj which has expelled a class 8 student for misconduct.

Akshay Pratishthan School had allegedly expelled its student Akash Paswan for misconduct.

‘Wont take him back’

“The alleged misconduct pertains to leaving the school premises during school hours without permission for a short duration on October 19. I have personally spoken to the school principal.  But the principal is adamant on not to take the student back,” said advocate Ashok Agarwal.

He said the action is violation of Right of Children to Free and Compulsory Education Act, 2012.

“According to Section 16 of the Act on prohibition of holding back and expulsion—no child admitted in a school shall be held back in any class or expelled from school till the completion of elementary education,” said Agarwal.

Help child

He said the school should counsel the child for taking such a step instead of expelling him.

“The alleged misconduct is of minor nature and it is the responsibility of the school to provide counselling to the child for his mistake. Instead, it has chosen to wash its hands off and jeopardized the child’s fundamental right to education,” added Agarwal.

Social Jurist has requested the school to take the child back with immediate effect so that he can continue his studies as the child has been out of school for more than a month now,” he said.
