SC junks Salman's case transfer plea

The Supreme Court on Monday rejected a plea made by the mother of the deceased Mumbai Police constable, Ravindra Patil, seeking transfer of Bollywood actor Salman Khan’s appeal pending before the Bombay High Court (HC) in the 2002 hit-and-run case.

Patil, who worked as bodyguard to the actor, was with him in the car that ran over pavement dwellers in the wee hours of September 28, 2002, killing one and injuring four persons. He died in October 2007.

A three-judge bench presided over by Chief Justice H L Dattu dismissed the petition filed by lawyer M L Sharma on behalf of Sushila Bai HR Patil.

The Bombay HC is hearing the appeal filed by the actor against his conviction and five-year jail term. Sharma said there was no chance of getting justice in Maharashtra and hence the appeal filed by Khan should be transferred to the Delhi High Court.

He cited the extra-ordinary haste with which the Bombay HC had on May 6, without having a proper appeal, granted Khan interim bail after he was convicted by the Mumbai Sessions Court and two days later suspended the sentence and granted him bail, raised suspicion about a fair hearing.

Sharma alleged that the convict, having connection in the state police, succeeded in eliminating Patil.
The court, after hearing the counsel for a while, declined to entertain the petition.
