Raj Bhavan seeks status of SIT case against Justice Bhaskar Rao

 After keeping the file pertaining to the Prosecution Sanction Order (PSO) request against former Lokayukta Justice Y Bhaskar Rao for over two months, the Raj Bhavan has sent it back to the state government for a clarification. The Raj Bhavan has sought to know the status of the case in which the Special Investigation Team (SIT) wants to prosecute Justice Rao.

The SIT had sent a 500-page report to the government stating that Justice Rao did not take any action to stop the extortion and corruption racket by a gang led by his son Yerabati Ashwin. The SIT wanted to press charges against Justice Rao in the first case, which blew the lid off the whole scam. The case pertains to the accused threatening and demanding bribe from Executive Engineer of Bengaluru zilla panchayat M N Krishnamurthy.

The report had stated that Justice Rao did not take any action despite knowing that his son was using his official residence and office to summon public servants.

Sources said the Raj Bhavan has only sought to know the status of the first case chargesheeted. “The first chargesheet (in the FIR number 56/2015) is at the pre-trial stage. The court is yet to frame charges. The government will communicate the same to the Raj Bhavan soon,” the source said.

The state government had immediately forwarded the report seeking Prosecution Sanction Order (PSO) to Raj Bhavan. The SIT has stated it has evidence to press charges against Justice Rao under IPC Sections 202 (intentional omission to give information of offence by person bound to inform) and 217 (public servant disobeying direction of law with intent to save person from punishment or property from forfeiture).

Justice Rao resigned in December 2015 after the state legislature adopted a motion to remove him from the post of Lokayukta.

SIT report

The SIT report stated that Justice Rao provided all documents to his son Ashwin, within 24 hours, only to allow him to move the High Court challenging investigation initiated by Lokayukta police.

The report stated that Justice Rao deliberately delayed taking action on the report submitted by former Lokayukta (City) Superintendent of Police Sonia Narang about the demand of bribe in the office of former Joint Commissioner (PRO) Syed Riyaz.
