No FC for vehicles without speed governors, says High Court

The High Court of Karnataka on Wednesday directed the Transport department and the commissioner for Transport and Road Safety not to issue fitness certificate (FC) for vehicles which are not fitted with speed governors.

A division bench comprising Chief Justice S K Mukherjee and Justice P S Dinesh Kumar passed the order while hearing a public interest litigation.

The petitioner Y N Nanjappa, who lost his son in a road accident, had moved the court seeking directions to the state government for making speed governors mandatory in vehicles manufactured prior to October 1, 2015.

He had also sought quashing of the government notification which exempted vehicles with a speed of less than 80 kmph, from installing speed governors.

The petitioner had prayed that speed governors be made mandatory for issue of fitness certificate for all categories of vehicles.
