Conspiracy is difficult to prove. Only conspirators know how they have conspired.Munmun threw the drug when she got to know the ship will be raided. We have CDR records to show she was in touch with Ishmeet. The statements of Baldev and Mummum(voluntary statements ) state she had the drug: ASG
ASG's submission is three fold.
-he(#AryanKhan) was found in conscious possession.
-he was connected with drug peddlers.
- Arrest is valid. It is only a lapse of 4 hours for remand.
ASG citedthe Supreme Courtorder in Pragya Singh Thakur's case. "They are all on the same point. That if by a valid judicial order a remand has been given...then not informing grounds of arrest cannot be claimed."
ASG respondedto Mukul Rohatgi's argument of illegal arrest saying,"Three remand orders of the magistrate have not been challenged. So now the accused cannot say the arrest is illegal".
ASG is citing para 14 and 15 of Ratan Malik's judgement on conscious possession.
Sameer Wankhede Vs Mumbai Police | Mumbai Police has assured Bombay High Court that threedays notice will be given before arresting Sameer Wankhede
ASG referredto the Supreme court judgement in Ramsangh to say that in NDPS offences, "custody is the rule, bail is the exception".

Maharashtra minister Nawab Malik, who has repeatedly termed the NCB's cruise drugs case as "fake", on Thursday sought to know why no action was taken against organisers of the cruise party.
He also claimed that an organiser of the cruise party was a "friend" of the Narcotics Control Bureau's (NCB) Mumbai zonal director Sameer Wankhede. An NCB team led by Wankhede had on October 2 raided the cruise ship off the Mumbai coast and claimed to have seized drugs. (PTI)
"It cannot be said that it (drugs) were only for consumption. We have applied Section 29 because out of 11 names in the secret note, 8 have been apprehended," ASG said, addingthat the cumulative drug quantity was commercial.
It was a colourful party that day.I was saying at least on Gandhi Jayanti you should have left these things:ASG
We have WhatsApp chat and the 65B certificate as well. Drugs were found from all of them: ASG
"Aryan and Arbaaz are childhood friends. They travelled together, they were going to be put up in the same room. They are saying we haven't tested for consumption. Where is the question of testing when they haven't consumed it? They were found in possession. It is our case thatAryan Khanwas found in conscious possession of the drug," ASG has said.
If two people are travelling together, and the first person knows the drug is with the other and it is for their consumption, even though the person may not be in actual physical possession, he may be in "conscious possession": ASG for the NCB
The Additional Solicitor General has saidthat even if Aryan is not found in possession, and an attempt is made, section 28 will apply. And if there is a conspiracy, automatically the rigours of section 37 of the NDPS Act will apply for bail.
ASG, in his arguments for NCB, saidAryan Khanis not a first-time offender. "He is a regular consumer for the past few years and the record shows that he jas been providing drugs. And there is a reference of bulk quantity and commercial quantity of drugs. He has been in contact with drug peddlers," he said.
