The Supreme Court on Monday ordered for resumption of the day-to-day trial in the 18-year-old Rs 66.65 crore disproportionate assets case against Tamil Nadu Chief Minister J Jayalalithaa in the Bangalore court.
The apex court had on April 7 ordered the special judge to keep the trial in abeyance for three weeks after Special Public Prosecutor (SPP) G Bhawani Singh submitted that he was not well and had to undergo medical treatment.
A bench of Justices B S Chauhan and J Chelameswar directed for resumption of the proceedings after senior advocate Nagendra Rai, appearing for SPP, said that he has recovered from his illness.
The apex court also reduced Rs 1.20 lakh cost–imposed on Singh by the trail court for seeking adjournment for two days–to Rs 20,000.
The SPP approached the apex court against the order of the Karnataka High Court which had refused to allow his plea and dismissed his petition against the trial court order imposing a penalty of Rs 60,000 per day for seeking repeated adjournments in the trial and causing delay in the judicial process. The trial court had on March 14 fixed the amount based on the fees the state government was paying to the prosecutor to conduct the trial.
