The Supreme Court on Monday refused to issue direction to the CBI to produce a status report on its investigation into the disproportionate assets case against SP leaders Mulayam Singh Yadav and Akhilesh.
A bench of Justices Ranjan Gogoi and Prafulla C Pant dismissed a plea by Vishwanath Chaturvedi, on whose PIL a CBI probe was ordered against the Samajwadi Party chief and his son in 2007. Chaturvedi sought direction to pass an order on the pending review petition.
“We are of the view that the prayer made in the present petition has been answered in our order dated December 13, 2012,” the bench said.
The court, however, granted liberty to the petitioner, represented by senior advocate K T S Tulsi, to file a fresh plea (as he was de facto complainant), if he so desired, for any direction to the CBI.
Infructuous petition
The court dismissed the petition as infructuous, noting that there was no prayer with regard to the CBI for any direction, even though Tulsi had made an oral request in this regard. The apex court had on December 13, 2012, directed the CBI to “proceed” with its probe against the three, including Mulayam’s younger son Prateek, in the disproportionate assets case.
No probe against Dimple
The investigation against MP Dimple Yadav, Akhilesh’s wife, was dropped by the court as she was not holding any public office at that time. The CBI had, curiously enough, changed its stand in the case several times since 2007.
