A division bench of Justice A.K. Sikri and Justice Ajit Bharihoke accepted the restoration application of Gaurav Saini, who married Sahibabad resident Monika Dagar, and posted the matter for April 16 for another court. Earlier the court had disposed his plea and asked Saini to approach an appropriate court for justice as his plea for tracing the victim had lost its relevance after her death.

The court's remark came after Ghaziabad Police submitted a status report and results of a polygraph test conducted on the family members of the victim of the alleged honour killing. It was after the court's direction that Sahibabad Police had registered a case of murder and kidnapping against all the family members of the girl.

Police had later recovered the girl from her husband Gaurav Saini's house in the national capital and arrested him. After getting her medically examined and recording her statement before a magistrate, police had handed over Monika to her mother and brother.

Saini moved the high court after being granted bail. On his petition, the court asked police to trace her and present her before it. However, a day after the court's direction the girl died and was cremated the following day without an autopsy.
