The Lokayukta special court on Friday dismissed the bail applications filed by suspended Joint Commissioner (PRO) Syed Riyaz and other accused Ashok Kumar, Srinivasa Gowda and Shankare Gowda in the first case of attempt to extort money from PWD executive engineer M N Krishnamurthy. The court extended the judicial custody of the accused till August 27.
The prison authorities had produced all the four accused, arrested by the Special Investigation Team (SIT) in connection with the first FIR (56/2015), since their judicial custody had expired. The special court judge V G Bopaiah pronounced the orders on the bail applications filed by all the four accused.
The Special Public Prosecutor for the SIT K Janardhan said the court held that since the investigation was in the initial stages, it was proper to wait till the investigating agency submits the final report.
“The court held that the evidence produced by the investigating agency so far, has made out a prima facie case against the accused. The court also opined that it would be proper to wait till the investigating agency completes the investigation to know the complete details of the sensitive case,” Janardhan said.
The special public prosecutor had filed objections on the bail applications stating that Syed Riyaz was the custodian of the conference hall, which was used for the offence.
The PWD engineer Krishnamurthy, presently working at the Bengaluru Urban Zilla Panchayat, was also threatened to cough up money in the conference room on May 4. The probe so far established that Riyaz possessed the key to the conference hall, which also has an entrance from within his chamber, the prosecution argued.
The prosecution had also stated that on the instructions of Riyaz, Ashok Kumar and Shankare Gowda had destroyed both, the mobile phone and the sim card used to call Krishnamurthy. The court will pass orders on the bail application filed by Yerabati Ashwin, son of Lokayukta Justice Y Bhaskar Rao on Monday.
