The High Court of Karnataka has directed the Bengaluru Urban deputy commissioner to immediately allot an alternative piece of land to a man whose plot was acquired by the BBMP for extending a graveyard.
The man moved a contempt of court petition as the administration failed to allot him an alternative land on the court’s previous order.
A division bench of Justices Raghavendra Chauhan and H T Narendra Prasad was hearing the contempt of court petition filed by S V Yogeshwar, a resident of Yeshwantpur.
The petitioner stated that he had an agricultural plot in Yelahanka with a borewell. It adjoined a graveyard.
He alleged that the BBMP had illegally acquired his land for extending the graveyard and had not followed the acquisition process.
The petitioner thereafter filed a writ petition in the high court seeking directions to the deputy commissioner to allot an alternative plot to him.
On July 25, 2017, the court had directed the DC to grant the land against the one acquired by the BBMP, to the complainant within a period of eight weeks. Since the order was not complied with, a contempt petition was filed by the petitioner.
Allotted dumping ground
However, in order to escape the punishment for contempt, the DC allotted a piece of land to the petitioner that was a garbage dumping spot, which the petitioner did not accept.
On Monday, the court again observed that the deputy commissioner had failed to
comply with its orders to
grant an alternative piece of land to the petitioner immediately.
The court adjourned the hearing of the case to July 10.
