The Cancer Patients Aid Association had filed a petition in the Court praying for implementation of Section 6 (b) of the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003.

The Section prevents people from selling tobacco or related product within a radius of 100 yards of educational institutions. The Court directed BBMP to inspect all the educational institutions within BBMP limits to find out whether the sale of tobacco and/or related products within the specified distance is prevalent. The BBMP has also been told to find out the number of hawkers and sellers in these areas and whether any measures have been taken to remove them within the specified distance and submit a report to the Court within two weeks.

The Court also directed the other respondents, the Department of PU Education and the Department of Primary and Secondary Education to submit a report on what action was taken regarding implementation of the relevant section. They have also been directed to put up display boards banning such sale with 100 yards of the institutions and to issue a circular in the concerned departments.
