The high court has ordered the state government to explain what action it has taken on a petition that has sought a court-monitored probe by a neutral agency or the Central Bureau of Investigation (CBI) in a case of medical negligence.

The petition was filed by a woman who said she contracted HIV (human immunodeficiency virus) during a blood transfusion when she was being treated for an illness at a private hospital in the city in 2014.

She went to the jurisdictional Sadashivanagar police station but her complaint was not taken. Though police registered an FIR after she filed a private criminal complaint, no further action was taken.

An Additional Chief Metropolitan Magistrate (ACMM) court directed the Central Investigation Department to probe the matter and ordered the police to hand over the case to the CID.

The state government, however, contended that the ACMM court does not have the authority to direct an investigation in such cases.

In response, Justice Raghvendra Chauhan asked the government as to what action it had taken with regard to the investigation.

The court sought a response by April 25.
