DVS, Jeevaraj given time to file objections

 The High Court on Wednesday gave more time to former chief minister D V Sadananda Gowda and minister D N Jeevaraj to file objections in a case pertaining to construction of a building by violating by-laws in HSR Layout.

Taking a dim view of the fact that the BBMP had accorded permission to construct the building, when the land was under the purview of the BDA, a Division Bench comprising Justice D V Shylendra Kumar and Justice B V Pinto observed that the Palike was synonymous with corruption.

The Bench also remarked that there were plenty of buildings being constructed in the City, in contravention of the building by-laws.

When the government advocate said that the petition was politically motivated, the Court dismissed the argument stating that the Court was required to see only whether rules had been flouted.

K G Nagalakshmi Bai had approached the Court seeking criminal action against the former chief minister for construction of a building violating by-laws. According to the petition, Gowda was allotted 24.84 guntas at Nelagunte village and he had approached BDA, seeking permission to amalgamate the adjacent site.

The BDA, however, rejected the permission. The petitioner had alleged that Gowda went ahead and constructed a complex in a residential layout flouting norms.
