FIRs against BSY: HC orders notice to Lokayukta police

The High Court on Friday ordered notice to Lokayukta police in a petition filed by former chief minister B S Yeddyurappa seeking to quash FIRs filed by the Lokayukta police against him over denotification of lands.

The petitioner has contended that the FIRs had not been filed as per Section 12 of the Lokayukta Act which provides for submitting a  compliance report before the competent authority, governor in this case. The FIR could be filed only after the governor gives the consent, the petition stated.

Secondly, according to the petition, the complaints about denotification and subsequent FIRs are based on the report of Comptroller and Auditor General and not on that of the Public Accounts Committee, which is normally placed on the floor of the House to decide on the matter. 

Furthermore, the CAG report does not say that the land has been denotified illegally. He has also contended that the FIR has been filed on the basis of a complaint lodged by a private person. Justice A N Venugopala Gowda ordered notice and adjourned the hearing.
