The State government has filed an application before the High Court seeking to vacate the stay that restrained it from sending the children, for admission to LKG and UKG under RTE quota, to the schools who are the members of the Associated Managements of English Medium Schools in Karnataka (KAMS).
The State government, in its application has stated that the petitioner, KAMS, has not disclosed complete details of the Sections of the RTE Act, 2009, and that there is a proviso given in the Section to include children for pre-school education in those schools, which had the facility.
The petitioner, KAMS, had approached filed a petition seeking directions from the Court to restrain the Department of Primary and Secondary Education and the Department of Public Instructions from sending children for admission to LKG and UKG under the RTE quota for the academic year 2016-2017 to the schools associated with KAMS.
The vacation bench of the court had granted the stay. The matter will be heard on Monday.
