The High Court on Wednesday dismissed a petition filed by the Kannada Kriya Samithi and others with regard to the violation of Section 29(2) f of the RTE Act, which states that the medium of instruction shall as far as practicable be the child’s mother tongue.

The petition challenged the government order dated May 15, 2012 to open government English medium schools. The Divisional Bench comprising Chief Justice D H Waghela and Justice B V Nagarathna dismissed the petition stating that English medium schools of the government are an additional facility and not a violation of RTE Act.

Stating that there is nothing wrong in the State government starting English medium schools, the bench orally observed that the medium of instruction was a choice of the parents as they want their children to get into IT and BT firms. The government has not made it mandatory to avail admission in these schools, the Court observed.
