The petition was admitted before a division bench comprising Justices Ajit Gunjal and C R Kumaraswamy.
After a five-year long trial, Shiva Kumar was sentenced to life imprisonment by the 11th Fast Track Court last October for the rape and murder of Pratibha, which led to revamping of security of women staff in the IT sector across the country.
Twenty-two-year-old Pratibha, who joined the firm in 2005 after her marriage, went missing on December 13, 2005 after leaving home for her night shift. Her body with her throat slit was found on the outskirts of the city a day later.
