During the hearing, the CBI submitted 30 volumes of charge sheets filed against the Minister. However, the counsel for the petitioner, Senior Counsel Ravi B Nayak said that there are deficiencies in the investigation, as the probe was not conducted by the CBI, and no documentary evidence was collected by it. The probe is based on the report submitted by the Vigilance wing of the State Bank of Mysore (SBM), the bank which had lent the money.
The Counsel submitted that over 150 persons had availed loans, of which 76 loans were sanctioned by MTV Reddy, Manager, SBM Gandhinagar branch.
He pointed out that the internal investigation was done based on the complaint, and the individuals who availed the loans are still unknown. The Counsel pointed out that the offence was detected in 2005, but the report was prepared in the year 2006, and the matter handed over to CBI in 2008. He sought to know the reason for the delay in handing over the matter.
Advocate General Ashok Harnahalli said that though the loans were for housing purpose, there was no development work. The loans were obtained by creating fake salary certificate. Justice Subhash K Adi, who heard the matter, adjourned it to Thursday.
