Uttara Kannada District Mogera Society had moved the Court seeking to inclusion of the community in the list of Scheduled Castes after the Social Welfare department refused to issue a caste certificate to the effect.
The department had claimed that Mogeras come under the Backward Classes. It was the case of the petitioner that the community with a population of 40,000 was treated as SC during the British Raj, but the Chennappa Reddy commission classified them as Backward Classes.
The Division Bench comprising Chief Justice J S Khehar and Justice H G Ramesh directed the State Government to issue circular including Mogheras in the list of SCs.
