HC directs CID to probe Bellary medical college PGET issue

Hearing a batch of writ petitions filed by the students whose results had been annulled following allegations of malpractice, Justice B S Patil directed CID to re-investigate the matter already probed by police and the Lokyukta.

The court directed the investigating agency to file the report on or before August 25, 2011.
Meanwhile, the court stated that it was "just and necessary to direct the respondent authorities to conduct fresh counselling for the nine students (who had been debarred from participating in the counselling) and eligible candidates should take admission in accordance with law".

The court, however, said petitioners' admission will be subject to the investigation and final order passed by it (court), on the basis of the report submitted by the CID.

Earlier, the judge observed "it is clear that both the reports (by the police and the Lokayukta), do not indict the petitioners of being involved in acts of malpractice as alleged. Mere suspicion cannot take the place of truth".

The judge said when it comes to a serious issue of annulling results of these candidates, nature of suspicion entertained is also such that it is based on certain circumstances such as inappropriate seating arrangement mobile calls and common wrong answers
